Form Coastal Club – Online Assumption of Risk & Liability Waiver

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT.

By creating an account, booking a class, purchasing a membership, or checking the "I Agree" box below, you acknowledge that you have read, understand, and voluntarily agree to the following:

Assumption of Risk

I understand that participating in activities at Form Coastal Club—including Reformer Pilates, strength and mobility training, yoga, wellness programming, infrared sauna use, self-guided workouts, instructor-led classes, digital kiosk workouts, and use of any Studio facilities or equipment—involves inherent risks that may result in serious injury, illness, property damage, permanent disability, or death.

I voluntarily assume all known and unknown risks associated with participating in these activities.

Equipment & Self-Guided Exercise

I understand that Pilates reformers and other fitness equipment contain moving parts and resistance systems that may cause injury if used improperly. I acknowledge that certain workouts may be self-guided through digital kiosks or on-demand programming, and that an instructor may not be physically supervising me at all times. I accept full responsibility for exercising within my own abilities, using equipment safely, selecting appropriate resistance, and stopping immediately if I experience pain, dizziness, discomfort, or uncertainty regarding any exercise or equipment.

Health Acknowledgment

I represent that I am physically able to participate or have consulted with my healthcare provider regarding my participation. I understand that Form Coastal Club does not provide medical advice and agree to discontinue participation immediately if I experience chest pain, dizziness, shortness of breath, fainting, severe pain, or any other concerning symptoms.

Release of Liability

To the fullest extent permitted by Delaware law, I voluntarily release and waive any claims against Form Coastal Club, Form Coastal LLC, and their owners, managers, employees, instructors, contractors, affiliates, agents, landlords, and representatives arising from my participation in Studio activities or use of Studio facilities and equipment, including claims based on ordinary negligence. This release does not apply to gross negligence, reckless conduct, intentional misconduct, or any liability that cannot legally be waived under Delaware law.

Personal Responsibility

I agree to:

• Follow all Studio rules and staff instructions.

• Inspect equipment before use and immediately report any unsafe or damaged equipment.

• Use Studio equipment only as intended.

• Accept responsibility for my own participation and decisions while on the premises.

Emergency Medical Care

If I become injured or experience a medical emergency while participating, I authorize Form Coastal Club to obtain emergency medical assistance if necessary. I understand that I am solely responsible for any resulting medical expenses.

Governing Law

This Agreement shall be governed by the laws of the State of Delaware. If any provision is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

Electronic Signature

By checking the boxes below and selecting "Complete Booking," "Create Account," or any similar confirmation button, I acknowledge that:

• I have read and understand this Agreement in its entirety.

• I understand that I am giving up certain legal rights, including the right to bring claims for ordinary negligence.

• I am at least 18 years of age, or I am the parent or legal guardian of the participating minor and agree to these terms on the minor's behalf.

• I voluntarily agree to be legally bound by this Agreement, and my electronic acceptance has the same legal effect as my handwritten signature.
